Public Discovery Access / Free Non-Commercial Use / Commercial License Required
Effective Date: August 11, 2026
This Sipseek Data License ("Data License") governs access to and use of data made available through Sipseek, including through sipseek.com, Sipseek MCP tools, Sip AI where applicable, catalog interfaces, and other authorized Sipseek data-access methods.
This Data License forms part of the Sipseek Terms of Service.
Scope
"Sipseek Data" means the organized beverage catalog made available by Sipseek, including brand and product records, descriptions, categories, tags, use-case classifications, curated attributes, product information, nutrition or ingredient information where available, source metadata, identifiers, relationships between records, and the selection, coordination, organization, and presentation of that information.
Sipseek Data does not include personal information submitted for brand verification, private proof-of-affiliation files, private administrative information, Sipseek software source code, user conversations with Sip AI, or intellectual property belonging exclusively to third parties.
Individual facts contained in Sipseek Data may not themselves be owned by Sipseek.
This license governs your contractual permission to access and use the Sipseek database and the protectable material and compilation rights that Sipseek possesses.
Public Discovery Access
Subject to this Data License and the Sipseek Terms of Service, Sipseek grants users and AI services a limited, worldwide, non-exclusive, non-transferable license to use Sipseek's designated public discovery interfaces to answer individual beverage-discovery requests.
This permission allows a public MCP client, AI assistant, search client, or other authorized interface to retrieve, display, summarize, and cite the bounded results returned for a specific end-user request. This narrow permission applies even when the client service itself is operated commercially.
Public Discovery Access does not grant permission to:
- systematically enumerate or extract the catalog;
- build, refresh, or enrich a separate database from Sipseek Data;
- retain results except for transient processing or reasonable caching needed to answer the request;
- train, fine-tune, evaluate, or create embeddings for an AI model or retrieval corpus;
- mirror, resell, sublicense, redistribute, or expose Sipseek Data through another API, MCP server, data feed, or competing search service;
- use Sipseek Data for internal business intelligence, market research, advertising profiles, lead generation, or unrelated product development; or
- exceed published limits or use the public interface as a substitute for a higher-volume integration.
Higher-volume integrations, bulk access, persistent data use, and uses beyond direct responses to individual discovery requests require separate commercial authorization from Sipseek.
Free Non-Commercial License
Subject to compliance with this Data License and the Sipseek Terms of Service, Sipseek grants you a limited, worldwide, non-exclusive, non-transferable license to access and use Sipseek Data for Non-Commercial Use without paying a license fee.
You may search, analyze, compare, reference, transform, and incorporate reasonable portions of Sipseek Data into a qualifying non-commercial project.
You may cache data reasonably necessary for that project.
Attribution to Sipseek is appreciated but is not required unless a separate agreement says otherwise.
Meaning of Non-Commercial Use
"Non-Commercial Use" means use without a direct or indirect commercial purpose and without an objective of commercial advantage or monetary compensation.
Typical Non-Commercial Use includes:
- a personal hobby project;
- classroom or educational use;
- genuine academic research;
- charitable or nonprofit activity not performed for a commercial client; and
- an open-source or community project that is not operated, sponsored, or used for a commercial purpose.
The identity of the user is not the only consideration.
A project that is free to end users may still constitute Commercial Use when it supports a business or profit-motivated activity.
Commercial Use
Except for the narrow Public Discovery Access expressly granted above, "Commercial Use" means any use by or for a for-profit entity or any use connected directly or indirectly with commercial advantage, revenue, compensation, monetization, business operations, or profit motive.
Commercial Use includes use in:
- SaaS services;
- paid software;
- commercial applications or websites;
- subscription products;
- internal business systems;
- commercial market research;
- business intelligence;
- consulting;
- client work;
- advertising-supported services;
- sponsorship-supported services;
- affiliate marketing;
- lead generation;
- sales activity;
- commercial recommendation engines;
- commercial AI systems; and
- products or services that use Sipseek Data as an input.
Use by an employee, contractor, consultant, agency, developer, or other person on behalf of a commercial organization is Commercial Use even if that individual personally receives no revenue from the specific use.
Testing, prototyping, research, or development undertaken for an intended commercial product or business purpose is Commercial Use.
A project with mixed commercial and non-commercial purposes is Commercial Use.
Commercial License Required
Except for Public Discovery Access, this public Data License does not grant permission for other Commercial Use.
Before using Sipseek Data commercially outside Public Discovery Access, you must obtain commercial authorization from Sipseek.
Commercial authorization may be provided through a paid commercial credential, enterprise credential, separate written license, order form, subscription, or other authorization issued by Sipseek.
The scope of a commercial license may differ from the free license and may include separate limits, permitted uses, pricing, redistribution rights, service levels, or other terms.
MCP Access
Sipseek's public MCP tools may provide Public Discovery Access without asking for a commercial or non-commercial declaration.
The absence of a declaration prompt does not grant rights beyond Public Discovery Access and does not waive the restrictions in this Data License.
Sipseek may require authentication or a separate credential for higher limits, persistent integrations, or other commercially licensed access.
Attempts to bypass access controls, share credentials to avoid licensing requirements, or use Public Discovery Access for a prohibited bulk, persistent, or substitute service terminate the applicable permission and constitute a violation of the Sipseek Terms of Service.
Redistribution
The Free Non-Commercial License allows use of reasonable portions of Sipseek Data within a qualifying project but does not permit you to publish, distribute, mirror, sublicense, or make available all or a substantial portion of the Sipseek catalog as a standalone database, bulk download, data feed, API, MCP server, search service, or substantially equivalent substitute for Sipseek.
This restriction applies whether the competing or redistributed service is offered free of charge or for payment.
You may display individual results or reasonable subsets of data as part of the functionality or output of a permitted non-commercial project.
Automated Extraction
Permission to access Sipseek does not constitute permission to systematically crawl, scrape, harvest, enumerate, or extract the catalog through unauthorized interfaces.
Automated use must occur through an interface authorized by Sipseek and remain within applicable rate limits, technical controls, and this Data License.
You may not circumvent pagination limits, authentication controls, rate limits, robots directives, access restrictions, or other measures designed to control access to Sipseek Data.
Artificial Intelligence and Machine Learning
Sipseek Data may be used in non-commercial research involving artificial intelligence or machine learning when the overall use qualifies as Non-Commercial Use and otherwise complies with this license.
Public Discovery Access permits an AI service to use bounded Sipseek results solely to answer the individual discovery request that caused the retrieval. Using Sipseek Data to build, train, fine-tune, evaluate, ground a persistent retrieval corpus, enrich a dataset, or otherwise operate an AI or machine-learning system beyond that direct response is Commercial Use and requires a commercial license.
Bulk model-training rights are not granted by this public Data License.
Using Sip AI as a consumer-facing feature of Sipseek does not itself grant you a separate license to extract, reproduce, train on, redistribute, or commercially exploit the underlying Sipseek Data used to generate a response.
Derived Data
Transforming, cleaning, categorizing, summarizing, embedding, scoring, enriching, or combining Sipseek Data with other information does not remove the commercial-use restrictions when Sipseek Data remains a material input to the resulting dataset, service, or product.
You may not avoid the commercial licensing requirement merely by changing the format of the data.
This provision does not claim ownership of independently obtained facts or information that you collected from sources other than Sipseek.
Independent Collection
Nothing in this Data License prevents you from independently researching beverage companies or collecting factual information directly from lawful third-party or public sources.
The license applies to data obtained from Sipseek and to use of the Sipseek database as a source.
Third-Party Rights
Sipseek Data may identify or reference brands, products, trademarks, websites, and information originating from third parties.
This Data License grants only the rights that Sipseek has authority to grant.
It does not grant a license to third-party trademarks, copyrighted material, publicity rights, patents, or other independent rights.
You are responsible for determining whether additional permission is required for your particular use.
Accuracy and Verification
Sipseek Data is provided for discovery and informational purposes.
Product information may change, and information collected from public sources may be incomplete, outdated, or inaccurate.
You should verify important product information with the applicable brand or current product packaging.
Sipseek Data should not be treated as authoritative medical, dietary, allergen, regulatory, pricing, or inventory information.
No Warranty
SIPSEEK DATA IS PROVIDED "AS IS" AND "AS AVAILABLE."
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIPSEEK DISCLAIMS WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, AND RELIABILITY.
Termination
Your rights under the Free Non-Commercial License continue only while you comply with this Data License and the Sipseek Terms of Service.
The Free Non-Commercial License terminates automatically for a use that becomes commercial unless the use remains entirely within Public Discovery Access or separate commercial authorization is obtained.
If your license terminates because of a violation, you must stop using Sipseek Data in the unauthorized activity.
Sipseek may also restrict future access to the Services.
No Implied Commercial Rights
Receiving data from a public endpoint, MCP tool, Sip AI response, search result, webpage, cache, integration, or other technical interface creates only the rights expressly granted by Public Discovery Access or another applicable license.
Failure by a technical system to block a request does not waive the commercial licensing requirement.
Changes to the License
Sipseek may publish updated versions of this Data License.
An existing commercial agreement remains governed by its own terms.
Continued access to the free service after an updated Data License becomes effective is subject to the updated license where permitted by law.
